DUI checkpoint tips: Be sure to keep these in mind

The best way to avoid trouble at a DUI checkpoint is to ensure that you are 100 percent sober every time you get behind the wheel. With this approach, the chance of being charged with driving under the influence of alcohol is very low (although not impossible).

Unfortunately, it’s not out of the question that you could make a mistake. For example, maybe you have a drink at a restaurant and then decide to drive home. While you’re pretty sure your blood alcohol level is below the legal limit, you’re not 100 percent certain.

Here are five DUI checkpoint tips to keep in mind:

  • Slow down and avoid erratic behavior. If you’re driving erratically as you approach a checkpoint it goes without saying that it’s a red flag. You need to slow down in advance and stay in your lane.
  • Don’t talk back to the officer. It doesn’t matter if you’re 100 percent sober or have been drinking, you should never talk back to the officer as this gives him or her reason to dig deeper.
  • Never drive with alcohol in your vehicle. Open containers are a no-no. Just the same, if you’re transporting alcohol, keep it in your trunk.
  • Don’t explain your rights. DUI checkpoints are legal, so there is no point in telling the officer that you don’t have to stop or follow directions.
  • You have the right to turn around. As you approach a DUI checkpoint, you have the legal right to turn around as to avoid it. However, when doing so, you cannot break the law. If you do, such as by making an illegal U-turn, it’s possible you’ll be pulled over.

Even if you follow these DUI checkpoint tips it’s still possible things could take a turn for the worse.

In the event of your arrest, don’t feel compelled to say too much.

In the days to follow, learn more about your arrest, your legal rights and the steps you’ll take to move through the court system. The information and knowledge you collect will help you implement the right DUI defense strategy.
