Resolving International Claims For Insurers

When your insured goes abroad or does business there, responding to an injury claim becomes much more complicated. With another country involved, issues such as which law applies and how evidence is to be gathered can add layers of complexity to an insurance liability dispute.

At Pearson & Paris, P.C., our attorneys have extensive experience in resolving insurance claims that arise outside of the U.S. Using strong litigation skills and international connections, we will take the actions needed to protect your interests.

Call 303-872-4719 for a confidential consultation to discuss your specific circumstances. From our office in the Denver area, we serve clients throughout Colorado, as well as nationally and internationally.

Responding Aggressively To Claims Against You

Our insurance defense representation in claims arising abroad is comprehensive and includes many adventure travel tours arranged by U.S. companies. We never take anything for granted, but instead act aggressively to probe the basis of the claim.

In one of our cases, for example, attorney Sean Paris traveled to Costa Rica to gather evidence showing that the terrain on a bicycle adventure tour was as-advertised. We hired a local surveyor to show that the plaintiff’s claims were exaggerated. As a result, the plaintiff voluntarily dismissed the case.

Gathering The Evidence To Support Your Position

The fair and transparent discovery tools that we have in the U.S. often do not exist in many other countries. We are well aware of these potential challenges and how they may affect the strategic choices we make on your behalf.

Accordingly, we always take into account whether the country involved in your claim has signed the applicable international protocol on gathering evidence: the UN Convention on Securing Evidence Abroad in Civil and Commercial Matters.

We also follow State Department guidelines for operating abroad. Our goal is to get as much useable evidence as possible without running afoul of restrictions that countries such as China may have on taking depositions and/or other evidence-gathering activities.
