Divorce FAQs

Divorce raises numerous questions. At the Denver-area law firm of Pearson & Paris, P.C., we’re here to help you through the process.

Below are some of the most common questions people ask us. It’s important to remember that each case is different. You should always consult with a lawyer about any aspect of your case.

1. I’m contemplating filing for divorce/I’ve been served with divorce papers. Now what?

Divorce is an intimidating prospect. On top of the emotional upheaval, you are now also facing complex legal concerns. The first step is to meet with an attorney who understands Colorado divorce law. At our firm, we can walk you through what to expect and help you develop a plan for moving forward.

2. How can I get custody of my child?

Custody determinations are focused on the best interests of the child. For most families, an all-or-nothing battle over child custody rarely results in a good outcome. Often, you can reach a win-win arrangement through alternative strategies such as mediation and negotiation.

3. How can I keep my home/retirement accounts/other assets?

For many couples, property division is a critical aspect of divorce. You understandably want a fair share of the property and assets you worked hard to acquire. Often, property division involves a give-and-take. Yet every situation is different. Our attorneys can work closely with you to develop a strategy for success, whether that means negotiating a favorable settlement or putting on a strong case in court.

4. How can I get alimony? How can I prevent my spouse from getting alimony?

Spousal maintenance (also called alimony) is not automatically awarded in every divorce case. Whether alimony is appropriate — and if so, in what amount — depends on your situation. The court will make a determination based on statutory guidelines that take into account your income, financial resources, lifestyle during the marriage and other relevant considerations. By working with an experienced family law attorney at our firm, you can develop a strong strategy for requesting or opposing an alimony award.

5. Will I have to pay child support? Can I get child support?

Colorado has formulaic guidelines for establishing child support obligations. These guidelines are largely based on both parents’ income. However, in some cases, it may be appropriate to deviate from the guidelines due to special circumstances such as self-employment. Our attorneys can walk you through the guidelines and evaluate whether any grounds for deviation apply.
